Restraining Orders / Domestic Violence
In the unfortunate event that your case involves drug or alcohol abuse and/or domestic violence, a restraining order may be necessary to protect the client and/or the minor children. In Orange County Superior Court, a domestic violence proceeding is a serious issue, and our courts give these matters priority over other matters.
At Castle & Monarch we thoroughly discuss all options available to our clients in determining whether or not to pursue a domestic violence application, and we will forcefully advocate for our clients and the minor children in obtaining appropriate restraining orders.
Further, in cases where the opposing party is inappropriately utilizing a domestic violence action (based upon false or no relevant information) as a sword to better their child custody case, we will defend against said tactics, and we will seek to enforce all available remedies for our clients against those who falsely bring a domestic violence application.
In cases of drug or alcohol abuse that do not rise to the level of domestic violence, Castle & Monarch will seek appropriate injunctive orders to restrain drug or alcohol use in cases where minor children are involved and where their safety is at risk.
