Child Support
In cases where minor children are involved, whether it is a divorce action (dissolution of marriage) or a paternity (children without marriage), child support will be an issue.
In the State of California, we have a Uniform Child Support Guideline formula which is calculated using various computer programs. There are a variety of factors that result in the appropriate Statewide Guideline child support figure. Under very few circumstances does the court vary from the Guideline.
In cases where only W2 income is involved, the calculation of the Child Support Guideline is quite simple. However, in cases for self-employed persons and people earning income from a variety of sources other than W2 income, and in cases where there are fringe benefits, the calculation of the income available for child support is more intricate.
The calculation of income available for support requires a skillful attorney, and in some cases the engagement of an accountant. Whether you are the payor or the recipient of child support, Castle & Monarch competently and skillfully obtain the best results possible in the best interests of our clients.
